Warranty Conditions
Warranty
Scope
Products sold by CASPE in the course of business-to-business (B2B) transactions are covered by the legal warranty against latent defects, in accordance with Articles 1641 et seq. of the French Civil Code, as well as, where applicable, by the manufacturer's warranty for the product concerned, the terms and duration of which are specific to each supplier or brand listed on CASPE.
The provisions relating to the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the consumer commercial warranty do not apply to sales concluded between professionals in the course of their business.
Duration and conditions of the manufacturer's warranty
The applicable warranty period is that provided by the product manufacturer (indicated on the product sheet, user manual, or provided warranty card). Unless otherwise specified, the standard manufacturer's warranty is 12 months from the invoice date, unless stated otherwise; the mention N/A indicates that no applicable warranty is provided.
For medical devices, the warranty is subject to the conditions of use, storage, maintenance, and periodic inspection prescribed by the manufacturer and applicable regulations (notably EU Regulation 2017/745 on medical devices).
Warranty claims
Any request to exercise the warranty must be submitted in writing to CASPE, accompanied by:
- the order or invoice number,
- the reference and batch/serial number of the product concerned,
- a precise description of the observed defect,
- any useful supporting documentation (photos, failure report, etc.).
CASPE reserves the right to have the product inspected, directly or through the manufacturer, before accepting the claim.
Warranty exclusions
The warranty does not apply in the following cases:
- normal wear and tear of the product, insufficient care, or lack of maintenance in accordance with the manufacturer's recommendations,
- use not intended for the product, contrary to its user manual, or in violation of applicable standards,
- modification, repair, or intervention carried out by an unauthorized third party,
- non-compliant installation, storage, or conditions of use (notably a breach of the cold chain for sensitive products),
- damage resulting from impact, dropping, an accident, or force majeure,
- single-use products, consumables, or products past their expiration date,
- an apparent defect that should have been reported during the inspection upon receipt (see Article 1.4).
Claims handled by the manufacturer
For many products listed on CASPE, the warranty is provided directly by the manufacturer or its authorized network. In such cases, CASPE will assist the professional customer with their procedures but is only subject to an obligation of means regarding the submission of the claim and the follow-up of the file with the manufacturer.
Repair, replacement, or credit
In the event of a defect covered by the warranty and duly established, CASPE or the manufacturer will, depending on the circumstances and at its discretion:
- repair the product,
- replace it with an identical or equivalent product,
- or issue a credit note corresponding to the value of the defective product.
No cash refund will be issued under the warranty unless expressly agreed otherwise by CASPE.
Costs associated with exercising the warranty
If, after inspection, the defect is not found to be covered by the warranty, the inspection, round-trip transport, and labor costs incurred will be charged to the professional customer.
Effective as of July 13, 2026.
